CPC 1908 — Section 2(6): foreign judgment

JUDGMENT
§ SECTION 2(6) · CPC 1908

foreign judgment

Just five words in the Code — the judgment of a foreign Court. Its whole weight comes from what the Code does with it next.

foreign Court · s.2(5) → its judgment  =  foreign judgment · s.2(6)
Bare Act — Section 2(6), CPC 1908

“foreign judgment” means the judgment of a foreign Court.

A pure pointer definition: it borrows its meaning from “foreign Court” (s.2(5)). The real law sits in ss.13, 14 and 44A — whether, and how far, such a judgment binds in India.
