This section is no longer in force. It once barred a benami suit against a court-auction purchaser; the Benami Transactions (Prohibition) Act, 1988 repealed it.

The section used to bar a suit against a court-certified execution-purchaser on the ground that the purchase was made on behalf of the plaintiff (a benami claim). It became unnecessary once the Benami Transactions (Prohibition) Act, 1988 prohibited benami transactions generally — so s. 7 of that Act repealed it (w.e.f. 19-5-1988).
