Suit Against the Certified Purchaser — Section 66 [Repealed]
This section is no longer in force. It once barred a benami suit against a court-auction purchaser; the Benami Transactions (Prohibition) Act, 1988 repealed it.
§ 66
[ Repealed ]
Section 66 carries no operative text today
Former marginal heading: Suit against purchaser not maintainable on ground of purchase being on behalf of plaintiff.
Repealed by the Benami Transactions (Prohibition) Act, 1988 (45 of 1988), s. 7 — with effect from 19-5-1988.
In short
The section used to bar a suit against a court-certified execution-purchaser on the ground that the purchase was made on behalf of the plaintiff (a benami claim). It became unnecessary once the Benami Transactions (Prohibition) Act, 1988 prohibited benami transactions generally — so s. 7 of that Act repealed it (w.e.f. 19-5-1988).
